Study On The Legal System Of Marine Biodiversity Protection In China

With the development of economy and the rapid consumption of resources,human beings have accelerated the development of Marine resources.In face of the ever-increasing demands of human beings,the species and quantity of Marine living resources have been drastically reduced.Coupled with habitat loss,physical damage and chemical pollution,Marine biodiversity has deteriorated and developed into a global problem.In recent years,our country has taken a series of actions to protect Marine biodiversity,such as formulating and revising a lot of laws and regulations to protect biodiversity,strictly controlling sea reclamation,and promoting the ecological restoration of sea areas,islands,coastlines and coastal wetlands.However,due to the late promotion of conservation and restoration work,the correlation system still has a blind area,and the various Marine biodiversity protection systems still need to be debugged to anchor the optimal solution.In general,Marine biodiversity and its protection systems lack strong legal "driving force",and there are still shortcomings in the management mode,implementation level,supervision and guarantee links of each protection system.From the perspective of international law,this paper interprets the normative measures of Marine biodiversity in the Convention on Biological Diversity and the United Nations Convention on the Law of the Sea,and analyzes the distinctive systems of non-regional countries such as France and the United States.We will improve various Marine biodiversity protection systems in our country on the basis of introducing foreign experiences.Prioritizing the development of biodiversity protection laws to play a leading role;Scientific planning of national Marine parks and Marine ranches to create standardized protected areas;Optimize and improve the ecological compensation and ecological damage compensation fund,build strategic environmental economy;We will standardize and improve ecological monitoring and environmental law enforcement to enhance the capacity and sustainability of the protection system.Based on the relevant system of Marine biodiversity protection in China,combined with Chinese characteristics and foreign experience,a Marine biodiversity protection system involving prevention and management in advance,monitoring and law enforcement in the process,and compensation after the event is established,which is exclusive to China and combines environmental ecological governance with economic incentives.
