A Case Study On Community Correction Of Prisoners In Dongxing District,Sichuan Province

Community correction originated in Britain.At present,the western developed countries(the United States,France,etc.)have formed a relatively complete community correction work system.In our country,the implementation of non custodial corrective punishment or test(the announcement of probation)for the four types of criminal objects,namely,those who have been sentenced to probation,those who have been sentenced to public surveillance,those who have been sentenced to parole,and those who have been temporarily executed outside prison,is called community correction.The judicial administrative organ is responsible for the guidance,management,organization and implementation of community correction.The people’s court shall make a judgment,ruling or decision on the defendant or criminal who meets the conditions for community correction according to law.The People’s Procuratorate shall legally supervise all aspects of the implementation of the law on community correction.The public security organ shall promptly investigate and deal with the community correction objects who violate the provisions of the administration of public security and commit new crimes.The community correction law enforcement brigade of the county level judicial administrative organ shall supervise,educate and assist the correction objects.The judicial office is responsible for the daily work of community correction.Community correction institutions organize and lead social workers and volunteers to carry out community correction work together.Relevant departments,village(resident)committees,family members,work units,schools,etc.shall assist the Judicial Bureau in carrying out community correction for prisoners.As one of the newly introduced penalty execution methods from abroad,community correction is mainly a new mode of supervision and management of community prisoners through the guidance of the government and the joint participation of multiple subjects.It not only reflects the current criminal policy guidance of "tempering justice with mercy" and the humanization of penalty execution in China,but also reflects the development concept of diversification,socialization and innovation of public management subjects in China.This paper uses the methods of literature research,comparative research and case study to start from the perspective of public management.Through the analysis and Research on the correction subjects,correction methods and correction objects of the community correction of prisoners in Dongxing District,the overall effect of the community correction of prisoners in Dongxing District is very good at this stage.However,in the management,there are also problems such as weak awareness of the management objects,insufficient community participation,insufficient participation of social forces The main reasons for these problems are the slow construction of community correction culture,the lack of political and legal support,the lagging formation of social forces,and the unclear relationship between departments.The general idea of strengthening the community correction management of criminals in Dongxing District is to actively cultivate and guide social forces to participate in the community correction management under the leadership of the government.It is necessary to strengthen the management and the construction of rules and regulations,the construction of grass-roots autonomous organizations,the participation of social forces in the community correction management,and the construction of the community correction management team.Firstly,it discusses the background and significance of this study,the research status at home and abroad,the theoretical basis,research methods and technical routes,in order to better understand the community correction of criminals in Dongxing District.Then it discusses the practice overview,main process,main measures and important results of community correction in Dongxing District,and takes Dongxing District as an example to illustrate the value of selecting community correction cases in Dongxing District.Then from the three aspects of community correction subjects,correction methods and correction objects,the author makes a longitudinal comparison and analysis,and obtains the experience and Enlightenment of community correction cases of prisoners in Dongxing District.
