Legal Protection Of Personal Rights And Interests Between Same-sex Unions

Homosexuality has always been a universal and widespread social phenomenon in the long history of mankind,and with the non-pathological arguments about same-sex couples as a special group and the concern for human rights,the same-sex couples are increasingly pursuing and safeguarding their rights.At present,there are22 countries in the world that legalize gay marriage by combining various forms with specific laws and regulations.However,at present,in our country,same-sex marriage is not recognized,so the related rights and interests of same-sex couples cannot be legally protected.In China,the legalization of same-sex couples is far from being solved,but the protection of specific rights and interests between same-sex couples needs to be solved in combination with the existing laws in China.Our country does not have a perfect social foundation for same-sex marriage legislation,and our same-sex couples are always faced with great pressure from traditional culture,pressure of public opinion,social concept and dispute settlement.Based on the legal protection of civil rights and interests between same-sex couples,this paper analyzes the specific provisions of legal protection of civil rights and interests between same-sex couples in different legislative environments in different countries,which can be used for reference by our country,combined with the worldwide legal provisions on the union,personal rights and voluntary guardianship of same-sex couples.With the acceleration of globalization,we still have a long way to go to legally recognize the marriage and family rights of same-sex couples.Part of this paper aims at the relevant regulations of same-sex couples in China’s existing legislation,and discusses how to solve the disputes between personal relationships of same-sex couples and the related legal protection.The other part,from the perspective of foreign legislative models,plans to put forward some legislative suggestions and legal system ideas on the protection of civil rights and interests of same-sex couples that are suitable for China’s national conditions.China’s current legislation on marriage and family can’t fully cover the protection of the personal rights and interests of same-sex couples.Therefore,discussing the protection mechanism of their personal rights and interests can not only alleviate this pressure,but also be a transitional measure to legally and reasonably solve the problem of legal protection of personal rights and interests between same-sex couples.The main purpose of this paper is to solve the urgent needs of the current legal protection of the rights and interests of same-sex couples,and at the same time lay the foundation for the formulation of the legal system of gay marriage in the future.
