With the development of artificial intelligence algorithms, algorithms act on all aspects of social life,semi-automated employment and automated employment are gradually widely used in the field of labor, and gradually from a single standardized employment field to a non-standardized employment field, from the large-scale recruitment of workers with low knowledge skills to the expansion of employment decisions of people with high knowledge skills. In addition, algorithms can help companies better manage workflow and achieve efficient recruitment and talent management. The field of labor is related to social security and stability. The formation of our labor legislation time is very early,in the face of the application of the algorithm in the field of labor at a loss. For algorithms, most Chinese scholars are based on the discussion of how to regulate algorithms, and solve the general problem of algorithm discrimination rather than solve the special perspective in the field of labor. This paper goes deep into the different situations of these algorithms in the labor field, and fully discusses the influence of algorithms on the field of labor and employment from the perspective of technology and market, the causes of unequal rights of workers caused by algorithms, the impact of algorithms on workers’ rights and interests, and the laws and regulations on algorithms at home and abroad, especially in the field of labor. In order to better protect the employment rights of workers in the algorithmic society, the paper puts forward the ethical rules and regulation ways that algorithm regulation should follow in the field of labor.
