| The real estate industry is the basic industry of China’s social and economic development.It has the characteristics of a wide range,a complex industrial chain and a huge amount of capital.It is also related to social stability and people’s contentment.The report elaborated the development direction of China’s real estate,and specifically proposed:"Adhere to the position that houses are for living in,not for speculation,and speed up the establishment of a housing system featuring multi-subject supply,multi-channel guarantee,and simultaneous rental and purchase." Since 2016,the national level has repeatedly emphasized the concept of "no speculation in housing and housing",and local governments have successively introduced a series of control policies such as purchase restriction,sale restriction and loan restriction,which have achieved good results in restraining the rapid rise of housing prices.But at the same time,the number of real estate disputes has also increased,putting considerable pressure on local governments to mediate.It can be seen that the issue of how local governments properly mediate real estate disputes needs to be solved,which is not only an important challenge to social stability,but also a major test of local government governance ability.The economic development district of K City studied in this paper has always attached great importance to the government’s participation in the mediation of real estate disputes,such as the delayed delivery of real estate,housing quality,false publicity,after-sales charter and other issues.Through a series of countermeasures,it has achieved good results,but there are still many problems that need to be solved.This paper studies the current situation and causes of real estate disputes in Jingkai District of K City,as well as existing problems in government mediation of real estate disputes,In this paper,new public service,public governance,information asymmetry,stakeholder theory,literature research,questionnaire survey,interview and other research methods are used to analyze the relationship between developers,government and buyers and real estate disputes,and to review the achievements of K City economic development District in real estate dispute mediation from 2016 to 2021.Combined with the actual cases,this paper analyzes the problems existing in the current government mediation,including the low utilization rate of administrative resources,low mediation efficiency,lack of professional talents,large number of complaints and low success rate of short-term mediation.At the same time,Wenjiang District of Chengdu City,Tonglu County of Zhejiang Province,Pengshui County of Chongqing City and other local governments in the mediation of real estate disputes are selected for reference.From the aspects of perfecting system guarantee,strengthening government supervision,enriching mediation means,and launching publicity and guidance,the government of Jingkai District of K City is futher improved to mediate real estate disputes.In order to reduce the number of real estate disputes from the source and improve the efficiency of mediation,further maintain the stable development of the local real estate sector,social harmony and stability,and also hope to provide reference and inspiration for other local governments in the mediation of real estate disputes. |
