Employment is the foundation of people’s livelihood,and the employment problem has always been the biggest livelihood problem in China.In order to reduce the occurrence of employment discrimination in all aspects of employment,strengthen workers’ understanding of equal employment rights and help workers find relevant legal basis when their equal employment rights are violated,it is very necessary to study the legislative guarantee of equal employment rights in China.Equal employment right belongs to the category of employment right,and its main guarantee content is reflected in anti-employment discrimination.It can be understood that people with labor ability and desire not only enjoy the formal equal employment right on the basis of equality in identity,rights,opportunities and rules guaranteed by the state through legislation,law enforcement and justice,but also enjoy the state’s protection of decent work,prohibition of employment discrimination,and strengthening employment and vocational training.Anti-sex discrimination,anti-special disease discrimination,anti-age discrimination and anti-identity discrimination are the main contents of equal employment rights.China’s constitution,laws,administrative regulations and administrative rules have made relevant provisions on the right to equal employment.Equality theory,human rights theory and social justice theory are the theoretical basis for the legislative guarantee of equal employment rights.However,at present,there are still some defects in the legislative guarantee of equal employment rights in China;First,the concept of equal employment right is not perfect;second,the abuse of employment autonomy by employers has not been effectively regulated;third,the legal responsibility of employers is not perfect.The main reasons for the defects in the legislative guarantee of equal employment right are as follows:it is difficult for employers to balance their employment autonomy with workers’ right to choose their own jobs;there is a phenomenon that the lower method restricts the upper method;law is not practical.We must improve the legislative protection of equal employment rights of Chinese citizens:first,improve the legislation related to equal employment rights,regulate the abuse of employment autonomy by employers and improve the legal responsibility of employers by improving the provisions of the Constitution and the law;the second is to improve the legal system of equal employment rights by eliminating contradictions between laws,strengthening the operability of laws and improving the responsibility system for the protection of equal employment rights.
