| In the era of big data,data has become an important strategic resource to ensure national stability and promote social development.However,while the government,enterprises and society are enjoying the great value and opportunities brought by big data,the security problems of cross-border data flow are also appearing repeatedly.At present,the research on the governance of cross-border data flow mainly focuses on the summarization and reference of foreign governance experience,as well as the discussion on the relevant legal aspects of data ownership,but the research on actual cases is not sufficient.This paper studies the governance of cross-border data flow through the research thread of "problems-main causes-countermeasures" with practical cases such as "Didi" data going out to sea,summarizes the shortcomings of the previous governance of data flow,analyzes the causes of related problems,and puts forward strategies to improve governance.It is found that there are still some deficiencies in governance concept,governance system,governance standards and talent infrastructure construction in China’s current governance of cross-border data flow,which are mainly manifested as follows: First,the awareness of governance and security of cross-border data flow is weak.Second,the management of cross-border data flow is chaotic,there is no special governance institution for cross-border data flow,the division of responsibilities among multi-departments is unclear,and coordinated actions are lacking.Third,there is a lack of targeted legislation to control cross-border data flow,and the concepts and standards of relevant legislation are relatively generalized,forming new data islands between departments and enterprises.Fourth,the utilization rate of cross-border data flow resources is low.Cross-border data fragmentation is serious,absolute quality is not high,and independent utilization rate is low.Based on the theoretical analysis of collaborative governance,social interests and global governance,this paper holds that the main reasons for the above problems are as follows: First,the government’s governance concept is backward,over-reliant on the traditional governance concept,and the governance concept of "attaching importance to the event before the event" is outdated.Second,the degree of collaborative governance is low,the bureaucratic governance model is deeply rooted,the sense of responsibility of social organizations is insufficient,and public participation is not high;The internal organization mechanism of the government is not perfect,the management system is too large,there is a lack of unified coordination mechanism,and there is a serious compartmentalization between the central government and the local government.Third,the legislation related to cross-border data flow lags behind,and there is a lack of a unified governance standard system for cross-border data flow.The legislation related to cross-border data flow is in the initial exploration stage,and government workers are over-reliant on mandatory punishment,so the initiative of legislative work is not strong.Fourth,the supervision technology is backward,and the talent pool is weak.There are relatively few leading talents in the party and government organs and government staff at all levels who understand the cross-border data flow.In the supervision and data development of cross-border data flow,there is a lack of corresponding technology and ability.On this basis,the research points out the ways to improve the governance strategy of cross-border data flow of Internet enterprises: First,improve the sovereignty awareness of cross-border data flow and improve relevant systems.Second,the government should actively improve the legislation of cross-border data flow security on the basis of connecting international consensus and basing itself on national interests.The third is to strengthen the level of collaborative governance.Government departments should lead the governance direction,industry associations should set up professional norms,non-governmental organizations should conduct flexible supervision,and respect the development needs of cross-border data flows in the Internet industry,so as to strengthen the level of collaborative governance of cross-border data flows.Fourthly,through continuous exploration and practice,we will further improve the governance level of cross-border data flow. |
