A Survey Report On The Implementation Of Articles 28 And 29 Of The <Regulations On The Protection Of Minors In Guizhou Province>

On September 1,2021,the Regulations on the Protection of Minors in Guizhou Province came into effect.The previous Protection of Minors Law,which came into effect on June 1,formally incorporated sex education and sexual assault prevention education into national law,stipulating the responsibilities of schools in this regard and requiring schools to develop corresponding systems to effectively provide appropriate sex education and sexual assault prevention education for minors of different ages.At the same time,in response to the frequent occurrence of "teacher-derived" sexual assault cases,the education administration and schools are required to conduct strict training and assessment for school staff to prevent the continued expansion of "teacher-derived" cases.In the case of ongoing abuse on campus,timely detection and reporting is required to establish a mandatory reporting system and increase efforts to protect minors.Schools also need to take measures to prevent sexual abuse of minors by staff and outsiders.It is not difficult to see that the Regulations attempt to urge the educational bodies and educational administrative departments to establish a comprehensive system for the prevention and protection of sexual abuse of minors before,during and after the incident by dividing their responsibilities.Over the past year since the implementation of the Regulations,many schools in Guiyang have actively performed their duties and carried out sexual assault prevention education,which has achieved good results,but there are still omissions and problems that need to be solved.This paper composes the Regulations,the Law on the Protection of Minors and other relevant laws and regulations,studies their legal basis and system connections,clarifies the responsible subjects,legal basis and scope of responsibility for the implementation of the Regulations,and explores the diversity of implementation methods for the further implementation of the Regulations.At the same time,through research,interviews and questionnaires,we investigate the current status of the implementation of the Regulations in primary and secondary schools in Guiyang City,learn in detail the achievements made in the implementation of the Regulations,analyze several aspects of the Regulations,such as publicity,implementation,justice,law-abiding and supervision,and conclude the reality that the implementation of the law is large but incomplete and extensive but not deep--such as the imperfect training and assessment system for school staff and insufficient awareness of the importance,while the education on sexual assault prevention for minors is not frequent,not deep and not effective.Finally,through a comparative study of excellent practices in other regions at home and abroad,we propose measures to strengthen social surface publicity,tighten institutional construction,diversify sexual assault prevention education,improve the ability of responsible subjects to fulfill their responsibilities,and broaden supervision channels to further implement the implementation of the Regulations and build a comprehensive pattern of protection of minors’ rights and interests.
