At a time when the digital economy is booming,data,as the most characteristic factor of production of the times,is the core engine for the transformation and development of China’s digital economy,as well as a core asset and an important strategic resource in the market competition of Internet enterprises.Enterprises,stimulated by lucrative economic interests,will adopt behaviours that exclude and restrict competition in big data to implement data monopoly and undermine fair competition.The special nature and manifestations of data are different from traditional monopolistic acts,and data monopolistic acts under the conditions of digital economy are more hidden and complex,and have a wider influence.The newly revised Anti-monopoly Law of the People’s Republic of China and the Anti-monopoly Guidelines of the Anti-monopoly Commission of the State Council on the Platform Economy emphasize the importance of data determination.Introducing and issuing related laws is an active reaction to monopolization in the digital economy,and it is also an important reflection of Chinese anti-monopoly policy.This paper takes the data monopoly behaviour of Internet enterprises as the research object,and combines the characteristics of big data to explain the theories related to data and big data,monopoly and data monopoly,so as to clarify the connections and differences among them and gain a more comprehensive understanding.On the basis of network effect theory and user lock effect,this paper analyses the reasons for the monopoly behavior of Internet companies,and probes into the features of internet companies’ data monopoly.Based on the Anti-Monopoly Law and other related laws,this paper studies the challenge to Chinese Internet enterprises’ data monopoly.On the basis of the actual situation in China,foreign experience on antitrust control of web enterprise is drawn upon to propose the regulation of the criteria for determining the dominant market position of data monopoly of Internet enterprises from the perspective of bilateral market supervision,improve the anti-monopoly legal system,enhance the level of administrative supervision and enforcement of data monopoly,and other governance paths and methods.This paper proposes the paths and countermeasures to regulate the market dominance of data monopoly by Internet enterprises,improve the legal governance model of data antitrust,and enhance the level of data monopoly administrative supervision and enforcement.The research in this paper is expected to have certain theoretical significance and practical value for the further development of anti-monopoly regulation in China’s digital economy.
