In the practice of continuously promoting the system of governing the party and governing the party according to the rules,the organizational law system of the Communist Party of China has played an important role in realizing the effective management of the party organization itself and standardizing the organizational power of the party.To further promote the development and improvement of the party’s organizational laws and regulations system,it is necessary to further systematize the current decentralized organizational laws and regulations,so that its governance efficiency can cover all kinds of party organizations at all levels,so as to realize the formation and operation of all kinds of party organizations at all levels,and always maintain the advanced nature and cohesion of party organizations,so as to promote the standardization and legalization of party governance.This paper studies the theme of the organizational law system of the Communist Party of China.The organizational law system of the Communist Party of China,as one of the four major sections of the inner-party legal system under the leadership of the Party Constitution,has unique connotations that are different from other sections.The party’s organizational laws and regulations are the inner-party laws and regulations that adjust the generation,composition,functions and responsibilities of various organizations at all levels of the party.They are mainly characterized by the specificity of the adjustment subject,the inheritance of the content,and the times.On this basis,a normative system with logical consistency and relative stability is formed.A complete system of organizational laws and regulations is the proper meaning to further improve the level of systematization of laws and regulations within the party,to improve the level of institutionalization of the party organization itself,to consolidate the authority of the party organization,and to promote the modernization of the party and state governance system and governance capacity.The formation and development of the party ’s organizational law system resonates with the party ’s development process.It has experienced four historical periods:the new democratic revolution period,the socialist revolution and construction period,the new period of reform and opening up and socialist modernization,and the new era of socialism with Chinese characteristics.The development of each period has its distinct characteristics of the times and value orientation.In general,the development process of organizational laws and regulations is a process of increasing systematization and standardization.In this process,adhering to the party’s overall leadership over the construction of organizational laws and regulations system,integrating democratic centralism into the organizational laws and regulations system,and providing institutional guarantee for the formation of a strict organizational system are important experience enlightenment for the development and improvement of the party ’s organizational laws and regulations system.In the process of building the party’s organizational legal system,it is necessary to adhere to the guidance of the four basic principles of the party constitution-based principle,top-level design and system planning principle,system completeness and normative order principle,and value coherence principle.By classifying the current organizational regulations according to the manifestations of different organizational regulations such as guidelines,regulations,rules,regulations,methods and rules under the party constitution.According to the central inner-party regulations,the ministry inner-party regulations,the local inner-party regulations and other different inner-party regulations,the effectiveness of the documents is stratified,and the specific contents of the party’s organizational regulations are integrated.These three methods are used to carry out normative analysis,so as to clarify the basic framework of the current organizational regulations system.This framework system is a panoramic analysis of the current organizational regulations.On the basis of this framework,the development of the organizational regulations system should conform to the actual needs of the overall construction of the party’s regulations and enter the stage of high-quality development,and promote its own development with the goal of codification.Codification is the sublimation of systematization and a higher level of systematization.It is necessary and feasible to realize the codification of organizational regulations.In the process of codification,it is appropriate to adopt the code mode of systematic code,and start the corresponding compilation work in a timely manner with the structure of " general principles+specific provisions" as the specific idea,so as to form a complete organizational code.
