| Since the 18th National Congress of the Communist Party of China(CPC),the Party Central Committee,with Comrade Xi Jinping at its core,has attached great importance to the building of the system of Party regulations and has formed a relatively complete system of Party regulations,promoting the construction of the system of Party regulations to a new stage of development.At this new stage of development,the codification of Party regulations has gradually entered the research perspective of scholars in order to promote the high-quality development of the system of Party regulations.Although the academic community is still in the initial stage of research on the systematization of Party regulations from the perspective of codification,as the highest form of expression of statutory law,the pursuit of completeness and systematization is in line with the needs of the construction of the system of Party regulations.It can be said that it is now the right time to study the codification of Party regulations.The system of Party regulations has many segments,of which the Party disciplinary regulations are a more specific area.The Party disciplinary regulations play a vital role in working ceaselessly to improve Party conduct and enforce Party discipline,and in persevering in combating corruption and upholding integrity.In the process of developing full and strict governance over the Party to a deeper level,the internal and external situation faced by the Party and the mission and tasks it shoulders are constantly changing,putting forward higher requirements for the construction of the Party disciplinary regulations.After more than 100 years of institutional practice,the Party disciplinary regulations have formed an institutional system containing a large number of Party regulations and Party normative documents,and provide a lot of experience for continuing to promote the construction of the Party disciplinary regulations system in the new era and the new journey.Party disciplinary regulations systems should uphold strict discipline to comprehensively govern the Party and highlight the importance of political discipline,strengthen the position of the Party Constitution in the Party’s discipline and regulations,and adhere to the concept of system and strengthen the systematization of Party disciplinary regulations.As the cage of the system becomes more and more dense,many of the problems with the Party disciplinary regulations are becoming more and more apparent,manifesting themselves in vague expressions of words,repetitive provisions,conflicting provisions,incoherent rules,incomplete rules,and imperfect mechanisms for the articulation and coordination of the Party disciplinary regulations with national laws.These problems have restricted the systematic and scientific development of the Party disciplinary regulations.The Party disciplinary regulations are highly interrelated with each other and have the advantage of being systematic.Therefore,at this new stage of development,in order to make up for the shortcomings of the Party disciplinary regulations,to build a perfect system of Party regulations,to prosper theoretical research on Party regulations and to enhance the development of the Party’s rule of law,the best way is to develop The Disciplinary Code of the CPC using a substantive codification approach,guided by the concept of moderate codification.The Party disciplinary code should be structured in the form of "General Provisions-Sub Provisions",under the guidance of Constitution and Party Constitution as the fundamental principle,unswervingly implementing the strategic principle of comprehensively and strictly governing the Party,making regulations scientifically,making regulations democratically,making regulations in accordance with regulations and the systematic principle.In terms of the internal structure of the code,the concept of "discipline" should first be clarified and used as the core to build the conceptual system of the Party disciplinary code and to achieve harmony and consistency among the rules within the Party disciplinary code.Secondly,in the General Provisions section,the rules,systems and basic concepts that are universally applicable in the Party disciplinary regulations are set out through the " Mention common factor method ".Thirdly,in the Sub Provisions,a system is formed around the concept of "discipline",which is closely linked to the operation of discipline and connected in procedures. |
