| Currently,economic globalization is developing at a deeper level,and the proportion of digital trade in international economic trade is increasing day by day.However,various digital trade barriers that follow have caused serious obstacles to the free development of global digital trade.Comprehensive and Progressive Trans-Pacific Partnership Agreement(hereinafter referred to as CPTPP),as a high-level regional free trade agreement facing the 21 st century,has the characteristics of high standards in the absence of existing international rules.Although China has joined the Regional Comprehensive Economic Partnership Agreement(hereinafter referred to as RCEP)and made a new breakthrough in the application of digital trade rules,there is still a big gap between China and CPTPP in the construction of institutional rules to regulate digital trade barriers at this stage.Based on the relevant rules of CPTPP regulating digital trade barriers,this paper compares them with similar rules in other free trade agreements by means of comparative analysis.At the same time,on the basis of combining the current situation of China’s governance of digital trade barriers and drawing lessons from CPTPP’s beneficial experience in regulating digital trade barriers,this paper puts forward valuable suggestions for China to regulate digital trade barriers under the vision of joining CPTPP in the future.This paper is divided into five chapters,the contents are as follows:The first chapter is the introduction of the paper,which mainly elaborates the research background and significance of this article,analyzes relevant research on digital trade rules at home and abroad,and points out the research methods,innovations,and shortcomings of this paper.The second chapter mainly summarizes the concept and main manifestations of digital trade barriers under CPTPP digital trade rules,including a brief discussion on the concepts related to digital trade barriers,such as digital products and digital trade,and then makes a general analysis of the characteristics of digital trade barriers compared with traditional trade barriers,and finally analyzes and discusses the necessity of CPTPP regulating digital trade barriers.The third chapter mainly combs and analyzes the specific provisions of the three digital trade rules aimed at regulating digital trade barriers in CPTPP,namely,prohibiting tariff collection,non-discriminatory treatment of digital products and free cross-border flow of data.The fourth chapter,based on the third part,compares CPTPP with similar digital trade rules in the newly established US-Mexico-Canada Agreement(hereinafter referred to as USMCA)and RCEP,so as to deepen the understanding of CPTPP digital trade rules.The fifth chapter,based on the analysis of the digital trade rules of China’s related free trade agreements and the current situation of domestic legal rules and system construction,puts forward reasonable enlightening suggestions for regulating digital trade barriers in China and provides reasonable theoretical support for China to join CPTPP as soon as possible from four angles: digital trade tariffs and domestic tax collection,non-discriminatory treatment of digital products,free flow of data across borders and promotion of free trade agreements. |
