The paper aims to discuss the regulation of data grasping behavior against unfair competition law.Firstly,the concept of data fetching behavior and its relationship with unfair competition law are expounded.It is pointed out that data fetching behavior may infringe others’ rights and interests.Then,it analyzes the current situation and existing problems of data grabbing anti-unfair competition law,including the lack of clarity and the dilemma of legal application.On this basis,this paper puts forward some countermeasures to solve the problem,including strengthening the formulation and improvement of laws and regulations,strengthening supervision and law enforcement,guiding industry self-discipline,and strengthening the application of technical means.In view of the domestic and foreign related research results,this article has carried on the model and the enlightenment to the data grasping behavior anti-unfair competition law regulation.The relevant research results abroad mainly involve the legal liability,privacy protection,technical means and so on,which can provide reference for our country’s anti-unfair competition law.The domestic related research results mainly involve the economic analysis of data grasping behavior,the choice of regulatory path and so on.These research results also provide support and inspiration for this paper.Based on the study of the anti-unfair competition law,this paper puts forward a series of countermeasures and suggestions to promote the healthy development of data crawling and protect the legitimate rights.
