The use of the Internet has penetrated into the lives of our people.As a new criminal form of libel,network libel has more serious infringement of legal interests.The content of Internet defamation spreads faster and in various ways,which is more harmful than traditional defamation.The regulation of online defamation behavior should be carried out in the aspects of "behavior mode","serious circumstances","defamation object" and "applicable procedure".Specifically,from the perspective of behavior mode,it should focus on analyzing what kind of behavior belongs to defamation behavior,how to identify the serious circumstances,whether the object of defamation should be divided into different types,and what standard should be applied in the procedure.In 2013,the Supreme People’s Court and the Supreme People’s Procuratorate issued the Explanation of some Issues on the Application of Law in the Handling of Criminal Cases of Defamation and other Cases Using Information Network,which is the perfection of our criminal law system for network defamation behavior in the aspects of criminal behavior,criminal plot,applicable procedure and so on.In the middle of 2015,the Criminal Law Amendment(IX)further stipulated the definition and sentencing standard of Internet rumors.Therefore,it can be seen that the criminal law has begun to pay more attention to the attack and regulation of network defamation activities.But because our country is relatively backward in this field of governance,the limits of relevant legal basis provisions are fuzzy and there are many shortcomings.As a result,many regulations on online defamation can not reach the ideal effect.
