| With the continuous deepening of market economy reform,the level of economic development in my country has continued to increase,and the number and types of heritage have continued to increase.The provisions of the "Inheritance Law of the People’s Republic of China" have been difficult to meet the needs of the people for heritage treatment.Against this background,the "People’s Republic of China Code" has emerged as the regulations of the estate administrator.The first chapter of this article mainly sort out the basic theory of the inheritance manager system,so as to grasp the inheritance manager system overall.First of all,the name of the inheritance manager system is studied,and secondly,explore the system’s functional transformation and value changes in history,and finally clarify the functional positioning in modern society.The second chapter inspects the legislative status and judicial practice of the legislative manager,and discovered that the civil liability and compensation request of the inheritance manager’s civil liability and remuneration request requires that the heir to give up the inheritance whether the inheritance must serve as the legacy of the estate administrator.Chapter III sort out the problems found to make it more systemic.Starting from the four aspects of the selection,exit mechanism,rights and obligations,and supporting systems of estate administrator,we will improve the system of legacy manager. |
