Research On WTO Rules For Cross-border Data Flow Of Digital Trade

In view of the topic of "WTO Rules on Cross-border Data Flow of Digital Trade",on the basis of sorting out the existing rules,the construction of the WTO cross-border data flow rule system for digital trade is prospected.The first chapter introduces the research background and research significance of the WTO rules on cross-border data flow of digital trade,puts forward the rapid development of digital trade in international trade,and crossborder data flow as the basis of digital trade,the formulation of relevant rules for crossborder data flow in digital trade is the requirement of the actual situation of international trade,so as to guide the orderly flow of data and ensure the development of digital trade.In addition,the current status of international legislation and research related to digital trade and cross-border data flow is sorted out and summarized,their legislative content,meaning and characteristics are clarified,the importance of cross-border data flow rules of digital trade is demonstrated from the individual,national and international levels,and the research questions are put forward.Chapter 2 sorts out and analyzes the norms of the traditional WTO framework agreement on cross-border data flow of digital trade,puts forward its application has many disadvantages in adjusting the new relationship of cross-border data flow of digital trade as an applicable standard for traditional trade.As the most far-reaching multilateral organization in world trade,the nature and status of the WTO determine that the WTO rule system plays a decisive role in the global digital trade cross-border data flow rule system.However,the rules that can be applied to solve cross-border data flow in the WTO traditional trade framework agreement are relatively fragmented,the corresponding normative provisions can only be found based on individual case analysis,and due to the age of formulation,it is easy to have a situation where the content of the provisions is out of touch with international customs,so there are shortcomings in using WTO traditional trade rules to solve the problem of cross-border data flow norms.Chapter 3 puts forward the new development of WTO cross-border data flow rules for digital trade,as well as the challenges for the future improvement of the WTO cross-border data flow rules system for digital trade,and the difficulties that China needs to overcome in it based on the previous collation and summary of the traditional rules of WTO cross-border data flow of digital trade.As for the new development of WTO rules,due to the great differences in the attitudes of WTO members on the supervision of cross-border data flows,the development of WTO e-commerce negotiations is still playing a game of multiple interests,and there are still many problems in the construction of rules.In addition,as an important participant in world trade and a member of the WTO,China also has many challenges in the construction of WTO rules for cross-border data flow of digital trade,and it is necessary to adjust and improve relevant rules.Chapter 4 puts forward suggestions for improving WTO rules and the difficulties that China needs to overcome,combined with the value tendencies and characteristics of countries or regions for the construction of cross-border data flow rules as reflected in the legislative content of regional agreements,and for the purpose of giving full play to the advantages of the WTO mechanism and promoting the development of digital trade.
