With the development and wide application of biometric technologies such as facial image,fingerprint,gait and iris recognition,the use of mobile payment programs such as wechat and Alipay,attendance card swiping,public place security and other program software have penetrated into all aspects of daily life,the protection of personal biometric information has become a problem that must be faced.Because personal biometric information is unique and irreplaceable,once it is leaked or misused,it will cause immeasurable loss to the information subject,so it must be legislated and protected in time.By clarifying the concept definition of personal biometric information,clarifying its connotation and extension,this paper points out that personal biometric information is a right,its attribute is concrete personality right.By comparing the legislative experience of the United States,the European Union and other countries in the protection of biometric information with the legislation status of the current Chinese laws,this paper puts forward a civil law protection system of personal biometric information based on the principle of "right of information self-determination",and improve the civil relief path from the aspects of the qualification of the responsible subject,the principle of liability,damage compensation and relief procedures,so as to fully safeguard the legitimate rights and interests of the information subject.
