| Administrative power refers to the power of national administrative organs to implement national laws and manage national affairs.With the continuous development of economic society and the sharp increase in administrative affairs,administrative power has penetrated into all aspects of people’s lives.At present,there are phenomena in the field of administrative law enforcement,such as non-compliance with the law,lax law enforcement,and impunity for violations,which have triggered social conflicts and harmed the legitimate rights and interests of the state and social public interests,as well as administrative counterparts.In the face of the illegal phenomenon in the field of administrative law enforcement,the existing supervision methods such as power organ supervision,judicial organ supervision,and social supervision have been difficult to achieve the ideal effect of supervision,and it is necessary to improve the supervision system of administrative power.Article 134 of the Constitution stipulates that the People’s Procuratorate is the legal supervision organ of the country,and the procuratorial organs have the power of legal supervision and have the power to supervise the implementation of laws.At present,the procuratorial supervision system for administrative law enforcement is not perfect enough to effectively supervise administrative law enforcement activities.This article starts from the theoretical foundation of administrative law enforcement procuratorial supervision,distinguishes between administrative law enforcement procuratorial supervision and related concepts,examines the legislative status of administrative law enforcement procuratorial supervision system and the experience of practical exploration in various regions,and summarizes the problems of China’s current administrative law enforcement procuratorial supervision system.Through the analysis and reference of the experience of foreign administrative prosecution systems,based on China’s national conditions,it is proposed that the construction of an administrative law enforcement procuratorial supervision system with Chinese characteristics should be carried out by improving relevant legislation,clarifying the scope of procuratorial supervision,improving procuratorial supervision methods,standardizing procuratorial supervision procedures,and improving procuratorial supervision mechanisms. |
