| Since the proposal of the "Belt and Road" initiative,cooperation between China and countries along the route has become increasingly close.As cooperation deepens,disputes arising from intellectual property have emerged.Against this background,it is important to explore the issue of intellectual property protection under the "Belt and Road" initiative.This article first analyzes the characteristics of intellectual property protection under the "Belt and Road" initiative and points out that intellectual property protection under this initiative is characterized by a wide range of subjects,differences in intellectual property systems among countries along the route,and a regionalized feature of intellectual property protection.Next,the article reviews the status quo of intellectual property protection in countries along the "Belt and Road" and the existing cooperation mechanisms,and points out the conflicts in the protection of foreign-related intellectual property among countries along the route.Based on the above analysis and review,the article concludes that there are problems such as low levels of intellectual property protection,incomplete systems and legal governance mechanisms,and a lack of dispute resolution mechanisms in countries along the "Belt and Road".Finally,the article proposes the establishment of an intellectual property integration system applicable to the "Belt and Road" region,to achieve legal coordination;countries along the route should improve their existing intellectual property systems while connecting their domestic intellectual property laws and foreign-related intellectual property laws in an orderly manner,so as to improve the level of intellectual property protection and promote the internationalization and specialization of intellectual property protection.Finally,a diversified dispute resolution mechanism including litigation,arbitration,mediation,negotiation,and online dispute resolution should be established. |
