| Under the background of more and more advertisements on online video platforms and their longer duration,online advertising filtering technology emerges at the historic moment,which not only brings better viewing experience to consumers,but also impacts the online video industry.As there is no clear definition of online advertising filtering behavior in our current law,and the judgment of the legitimacy of filtering behavior needs to take into account the necessity of business model protection,the balance of multi-interests and the guidance of industry development and other value and consideration factors,so it is difficult for the court to judge its legitimacy.Online advertising filtering behavior has been one of the typical types of unfair competition disputes in recent years.There are many cases of this type of unfair disputes,but there are great differences between the judgment results and the identification ideas.This paper will take the network advertising filtering behavior as the research object,through the analysis of the current advertising filtering unfair competition behavior of the old and new two ways of judgment,to explore the existing legal regulation of the problems.The author hopes to put forward some suggestions to improve the behavior of Internet advertisement filtering,to better regulate the behavior of Internet advertisement filtering,and to maintain the free and fair market competition order. |
