Research On The Legal Regulation Of Domestic Mental Violenc

Family harmony is the basis and premise of social harmony,and domestic violence is an important factor that destroys family harmony.The perpetration of family mental violence is usually accompanied by the perpetration of physical violence,and may even directly cause physical violence.The result of family mental violence on the victim is objective.The Anti-Domestic Violence Law of the People’s Republic of China(hereinafter referred to as the Anti-Domestic Violence Law)has already included domestic mental violence in the scope of regulation.However,in the practice of applying the Anti-Domestic Violence Law to regulate domestic mental violence,there are many problems,such as the difficulty in the definition of domestic mental violence,the difficulty of proving the victim of domestic mental violence and so on.Therefore,it is still necessary to continuously improve the relevant provisions of the Anti-Domestic Violence Law.Attention should be paid to the protection of victims of domestic mental violence who have been discovered,as well as to the protection of victims of "undiscovered" domestic mental violence.The identification and protection of family mental violence should adhere to the equality principle of the Civil Code of the People’s Republic of China as the core,clarify the legal identification standards of family mental violence,strengthen the publicity and education of anti-family mental violence,improve the punishment and education mechanism of perpetrators through legislation,and build a collaborative mechanism of family autonomy and assistance from state institutions and social organizations.We should raise awareness of equal protection of human rights and strengthen judicial protection of human rights.
