With the rapid development of network technology,Internet users tend to be younger,and a large number of minors’ personal information leakage problems occur.Minors are in a special stage of development,the disclosure of their personal information will lead to improper commercial use,digital identity out of control and other problems,seriously damage the physical and mental health of minors.Although laws such as"Personal Information Protection Law" and "Minors Protection Law"have made provisions on the protection of minors’ personal information,there are still many problems.For example,the legislation is not perfect,lack of operability,and the design of relevant regulations is insufficient.The related industries also have the problems of insufficient platform self-discipline,defects in verification methods,and fuzzy boundaries of corporate responsibility.Therefore,based on the relevant provisions of COPPA and GDPR,we can improve the protection of minors’ personal information in view of the existing problems.This paper mainly designs the protection rules of minors’ personal information from three aspects.First of all,from the macro aspect,to improve the relevant legal system,to build minors’ personal information right system;Secondly,from the micro aspect,rules should be formulated for specific problems.Including the rationalization of minors’ personal information identification standards,the implementation of differentiated guardian consent,the responsibility of the guardian part of the transfer to the information controller’s responsibility,clear corporate responsibility boundaries,the introduction of the "safe harbor" system five points;Finally,we should improve the supporting social security system.On the one hand,industry self-discipline should be strengthened and enterprises should be encouraged to explore designs to protect minors’ personal information.On the other hand,it is necessary to improve citizens’awareness of personal information protection and encourage two-way communication between parents and minors. |
