Research On The Problems And Countermeasures Of The Whole Process Management Of Confiscated Property In Y City

In recent years,the scale of income from fines and confiscations has gradually expanded,and the government has continuously increased its attention to the management of fines and confiscations.In December 2020,the central government issued the Notice on Printing and Distributing the Administrative Measures for Fines and Confiscations of Property(CS[2020]No.54),and publicized it through the website of the State Council.In late March 2021,the Ministry of Finance issued the Decision on Abolishing the Administrative Measures for Fines and Confiscations of Property and Recovering Stolen Money and Stolen Goods(Decree[2021]No.105),which adjusted the policy in coordination with the Administrative Measures for Fines and Confiscations of Property,We will better serve the promulgation of the Measures for the Administration of Fines and Confiscations,and do a good job in the connection work after the adjustment of relevant systems.The Jiangsu Provincial Department of Finance has implemented the spirit of the Ministry of Finance’s "Measures for the Administration of Fines and Confiscated Property"and issued the "Draft for Comments"(Su Fa[2019]No.6),According to the actual situation of our province,it has further clarified the provincial measures for the administration of fines and confiscated property,and is currently soliciting opinions from the public.According to a series of actions of the superior government,we can see that the central and provincial governments are working hard to standardize the management of confiscated property,which also shows the determination of the government to prevent the loss of state property and safeguard the legitimate rights and interests of the people.From the perspective of the management of confiscated property,this paper analyzes the problems encountered in the actual work through reading literature,field interviews and combining.From the perspective of hardware construction,it combs the policy construction,budget arrangement and public property warehouse setting of the management of confiscated property in Y City,and the outbound and inbound process,publicity and auction process,property pricing and supervision of confiscated property from the perspective of disposal supervision,so as to sort out and summarize the basic situation of the management of confiscated property in Y City.Based on Efficiency Theory,Equity Theory and Principal-Agent Theory,through the three dimensions of source construction,midstream disposal and terminal governance,we found that there are problems in the management of confiscated property in Y city,such as imperfect policy and system construction,inadequate budget and financial support,unreasonable public property warehouse construction,low efficiency in the disposal of confiscated property,bidders holding together to hold down the price of confiscated property,unreasonable valuation of confiscated property and lack of supervision,and found out the reasons,At the same time,it puts forward corresponding optimization suggestions to improve the management of confiscated property,including:from the perspective of source construction,it proposes to establish and improve the system related to the management of confiscated property,excavate financial resources to increase the guarantee of the confiscated budget,and clear the structure of the physical public property warehouse;From the perspective of midstream disposal,it is proposed to build a cloud platform for the disposal of confiscated property in Y city,extend the breadth and depth of auction publicity,and carry out joint meetings for the disposal of confiscated property;From the perspective of terminal governance,it is proposed to improve the form of information disclosure and assessment mechanism of fines and confiscations,unblock the reporting and complaint telephone,and establish a circular supervision system.I hope it can help the management of confiscated property in Y city.
