Invalidity Determination And Legal Consequences Of Construction Project Contract

The economic benefits created by construction industry occupy a very important position in our socialist market economy.During the epidemic,the "monster of infrastructure construction" fully demonstrated China’s speed and power.With the continuous rise of the construction industry,the construction contract related disputes are increasing day by day.Due to the complex and diverse legal relations involved in the construction project,and the construction project may involve many factors such as large amount of target,long time span,and many subcontracted projects,the invalidation and legal consequences of the construction contract of the construction project have become the key issues that the legal circle and judicial practice circles pay attention to and often discuss.The paper first introduces the concept and characteristics of Chinese contract validity recognition system and the construction contract,and then analyzes the legal basis of invalid recognition of the construction contract.Secondly,the legal rules and legal consequences of invalidation of the construction contract are expounded,focusing on the enumeration analysis of the common violations of the provisions of the forced law construction behavior,and then sum up the common legal consequences;Thirdly,the status quo and existing problems of invalidation of construction contract are studied and analyzed.Finally,from the aspects of strengthening the content management of construction contract,optimizing the qualification management of construction enterprise,and clarifying the settlement rules of invalid construction contract,the paper puts forward some concrete suggestions to improve the invalidation system of construction contract,hoping to provide reference for the benign development of our construction industry.
