| The rapid development of the Internet era has resulted in a wide variety of online performances.Information dissemination with the Internet as the background has rapidly penetrated into all areas of social life and has influenced people’s traditional living habits and way of thinking.However,while people enjoy the convenient conditions brought by the Internet,they ignore the new issues of intellectual property protection in the Internet era: one of them is the protection of performers’ rights in the network environment.in the 21 st century,a large number of network users,without the performers’ permission,take advantage of the convenience brought by the Internet to copy,disseminate,carry,edit and synthesize the published works of network performers in large quantities for public performance,and even some network users may distort the image of the performer,damaging the moral rights,property rights and other related rights and interests of the network performer.As the Chinese law is not clear on the subject and object of the network environment performer’s right,copying behavior,mechanical performance and other related contents,resulting in the infringing subject does not realize that their behavior has violated the relevant rights of the performer,or realize but because it is not protected by law,making it difficult for the network environment performer to defend their legitimate rights and interests.At present,the level of protection of intellectual property rights in China is constantly improving,the government and other relevant departments are also constantly strengthening the relevant legislation,should also improve the network environment performers right subject,object and other related content,the temporary reproduction rights,mechanical performance rights to cover them to solve the relevant infringement problems,which is more conducive to the network environment performers to protect their legitimate rights and interests,to create a good rule of law network space. |
