Research On Data Security Review System From The Perspective Of Overall National Security

The overall national security concept is an important part of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era.It enriches and expands the connotation of national security and is one of the important guiding ideologies for China’s national governance in the new era.Under the guidance of this guiding ideology,the national security legal system has been continuously improved.Especially in the field of data,with the full flow of data elements as one of the important means of production,its influence in the whole process of value creation and distribution and social operation is increasing day by day.The implementation of the Data Security Law is conducive to further enhancing the national data security assurance capability and strengthening my country’s response to national security risks and challenges caused by data.It clearly establishes a data security review system,and conducts data processing activities that affect or may affect national security.National Security Review.The current data security review system only has relatively macro content and expressions,and the specific system content and implementation methods need to be researched and formulated.This paper takes the overall national security concept as an analytical perspective,clarifies the conceptual connotation of the data security review legal system,shows its independent institutional value and functional orientation,and fully demonstrates the necessity and legitimacy of its establishment.Through analysis,it is found that this system is faced with the difficulties of review brought about by the characteristics of the data,the definition of national security concepts and review standards are difficult to define,the relevant data security supporting system is not yet complete,and there are contradictions in whether to set rights and remedies.Guided by the problem,through the experience of foreign investment security review and network security review development and improvement,combined with the beneficial attempts of relevant legislation and practice outside the territory,it is proposed to speed up the research and formulation of data security review methods;clarify important data and national core data,establish The catalogue of important data is continuously updated;the effective connection between various systems and methods is strengthened to ensure the comprehensive and efficient implementation of national security review;the prudent and reasonable grasp of power supervision and the remedies of the rights of the parties;actively participate in and promote international governance in the field of data security.
