Research On Mandatory Reporting System Of Juvenile Delinquency

Prevention of infringement against minors and combating crimes against minors have always been hot issues of social governance.To further solve the problems of difficulty in finding cases of infringement against minors and untimely reporting,the compulsory reporting system for infringement against minors is formally legislated,which as a compulsory active reporting intervention system requires specific persons to report to specific authorities when they find specific situations of infringement against minors,or else they will It ully reflects the principle of maximizing children’s interests,the state’s theory of parental authority,and the modern view of children,and has the basic features of inclined rights protection,systematic content,and intervention protection from the perspective of social law.Based on the theoretical basis of the concept and components of mandatory reporting system,characteristics and value analysis,the article firstly compares the origin and legal provisions of China’s mandatory reporting system,and summarizes the innovative points of local practice in conjunction with the rules and regulations of local operation of mandatory reporting system injudicial practice,so as to provide the theoretical and practical basis for the future development of mandatory reporting system.Secondly,we analyze the compulsory reporting systems of foreign countries and Chinese Taiwan,which are worthy of our reference in terms of specific reporting subjects,comprehensive reporting matters,standardized reporting procedures,clear legal responsibilities and subject protection provisions,and sound follow-up response mechanisms.In the process of implementing the system,there is a lack of awareness of the reporting subject,incomplete reporting system,incomplete guidance,and inadequate supporting service mechanism,etc.Finally,based on the innovative points of our local practical experience and the experience of overseas mandatory reporting system,we put forward some suggestions for further improvement of the mandatory reporting system in China,from strengthening the awareness of the reporting subject,improving the mandatory reporting system In order to build a systematic and comprehensive mandatory reporting system for minors,we hope to give full play to the value of the system.
