Research On Antitrust Regulatory System Of Algorithmic Price Discrimination

The development and application of artificial intelligence technology and big data not only bring convenience to our lives,but also facilitate illegal activities.The rapid development of the digital economy in today’s society has changed and reshaped people’s shopping methods and lifestyles.However,with the continuous development of algorithm technology,the problem of algorithmic price discrimination began to spread in Internet platforms.Algorithmic price discrimination is constantly threatening the legitimate rights and interests of consumers,the normal competition order of the market and the healthy development of the Internet economy.At present,the regulation of algorithmic price discrimination lags behind the evolution of algorithmic price discrimination,and the unequal status and information asymmetry between Internet platform operators and consumers are gradually increasing.Therefore,the regulation of algorithmic price discrimination is extremely urgent.This paper starts with the behavior of algorithmic price discrimination,discusses its concept and characteristics,explores the external appearance and internal essence of algorithmic price discrimination,and based on this,analyzes its operating logic hidden under technology.It also examines the basic theory of algorithmic price discrimination,and provides theoretical support for the use of anti-monopoly tools to regulate algorithmic price discrimination.After that,it further pointed out the current regulation of algorithmic price discrimination,and found that the current regulation of algorithmic price discrimination faces the regulatory dilemma of insufficient legislation,weak applicability and limited anti-monopoly regulation.On this basis,this paper examines the regulatory practice of algorithmic price discrimination outside the territory,and explores the experience that is beneficial to the regulation of algorithmic price discrimination in my country in the different regulatory models of EU "data protection" and "algorithmic governance" in the United States.Finally,by improving the existing algorithmic price discrimination legislation to build a legal regulation system for algorithmic price discrimination,and optimize the traditional anti-monopoly regulatory tools from three aspects:the identification of market dominance,the measurement of anti-competitive effects,and the clarification of legitimate reasons.It can effectively regulate algorithmic price discrimination.At the same time,in response to the abuse of algorithmic power,drawing on foreign experience,from the perspective of improving the "informed-consent" principle,strengthening the obligations of Internet operation platforms,and strengthening social supervision and administrative supervision,combined with the anti-monopoly regulatory path and legal regulation system,realize the realization of algorithmic control.Effective regulation of price discrimination.
