| The Sixth Plenary Session of the 19th Central Committee of the Communist Party of China deliberated and passed the "Resolution of the Central Committee of the Communist Party of China on the Major Achievements and Historical Experience of the Party’s Hundred Years of Struggle",which proposed to "strengthen the real economy and develop the digital economy".General Secretary Xi Jinping emphasized the need to "continuously strengthen and optimize my country’s digital economy."As the construction of digital infrastructure,the legal digital currency has become an important starting point for the development of the digital economy,and it has also added an important engine to the sustained growth of my country’s economy.In the "14th Five-Year" Digital Economy Development Plan announced by the State Council,it is pointed out that my country’s legal digital currency,which is currently in the process of research and development pilot,will continue to steadily promote the development of digital renminbi,and carry out pilot promotion in an orderly manner.In the context of the intertwined era of the new crown epidemic and digital transformation,the issuance and circulation of legal digital currency have a strong national strategic significance,and its safe development and healthy operation cannot be separated from the law as a guarantee.Therefore,this article discusses the legal digital currency from a legal perspective.Suggestions are made on the construction of the currency legal system,in order to realize the legal digital currency from ideal to reality.This article starts with the concept and characteristics of legal digital currency,and then discusses its currency and property attributes.Afterward,a detailed analysis of the foreign legal digital currency practice exploration projects such as the Jasper project in Canada is carried out,and the legal regulation of legal digital currency in Japan,the European Union,the United Kingdom,and other countries is combined to summarize the experience.Secondly,it explains the current research and development pilot progress,issuance principles,and issuance and circulation modes of my country’s legal digital currency,and proposes legal issues that may arise in the practice of digital renminbi in my country’s current currency legal system.Because legal digital currency is positioned as a cash payment certificate and has no physical form,functional design,and other characteristics,the current legal system of currency cannot be fully applied to legal digital currency,resulting in the existing anti-counterfeit currency,anti-money laundering work mechanism can not be very good.Currency is included in the scope of supervision,and legal digital currency relying on Internet digital technology brings a greater risk of data privacy leakage to its holders.Therefore,in the face of the challenges brought by legal digital currency,it is urgent to build a legal system for legal digital currency.The legal status of legal digital currency should be clarified,the management measures and implementation regulations of legal digital currency should be actively formulated,and the anti-counterfeiting currency should be improved for legal digital currency.and anti-money laundering mechanism,and improve the data privacy protection function of legal digital currency holders.In this way,a legal digital currency governance system is established,and the entire process of the issuance and circulation of legal digital currency is placed under the regulatory compliance framework. |
