Protection Of Refugee Rights Under International Law

In today’s international community,regional unrest and armed conflicts still exist locally,coupled with the rapid spread of the COVID-19 epidemic at the end of 2019,the international situation has suddenly changed,and the number of international refugees is increasing.According to the statistical yearbook issued by UNHCR on 16 June 2022,as at the end of 2021,some 8.932 million people had been displaced globally,including nearly 27.1 million refugees,5.3 million internally displaced persons and 4.6 million asylum-seekers.In 2022,armed conflict broke out in Ukraine,which has caused the displacement of 2 million people,of which the continued increase in the number of refugees is predictable.As innocent homeless,refugees enjoy the same basic human rights as all citizens of the world in law,but the protection of their rights are often difficult to achieve.With the increasing number of refugees,the solution of the protection of the rights of international refugees has become a key issue worthy of attention.From the perspective of institutions,institutions and implementation,combined with the international treaties,institutions and systems of refugee protection,this paper explores the current institutional establishment,operation and possible institutional defects of international refugee protection,and tries to put forward for China,the plan to improve the protection of the rights of refugees,in order to achieve the effective landing of the obligation to protect the rights and interests of international refugees.This paper is divided into three parts:introduction,text,and conclusion,in which the text is divided into five chapters.The introduction part introduces the research background,research status at home and abroad,research methods and innovation.The first chapter of this paper is an overview of issues related to international refugees.First,this paper introduces the historical origin of international refugees,and quotes the latest refugee statistical report of the main agency of international refugee protection,the United Nations High Commissioner for Refugees(UNHCR),to analyze and interpret the relevant data.it intuitively describes the current situation of international refugees.Secondly,this paper discriminates and clarifies the relevant concepts of international refugees as the starting point of the later discussion.The conceptual distinctions involved include the concepts and differences of international refugees,internally displaced persons,and asylum-seekers,which is a necessary process of understanding the status of "refugees".Finally,the first chapter of this paper also combs and summarizes the basic rights of international refugees and the legal origin of refugee protection.Then the paper starts from the perspective of institutions,institutions and implementation,takes the UNHCR with global characteristics and the African Union with regional characteristics as the breakthrough point,and analyzes the institutional change and institutional development of international refugee protection from the aspects of establishment background,norms and actual operation.The origin of UNHCR and the African Union refugee protection,some solutions given by the two agencies to protect refugees and the problems in the actual operation of their protection of refugee rights in the current global form are expounded respectively.The second chapter analyzes the plight of international refugee protection from three aspects:system regulation,implementation status and institutional establishment.First,at the institutional level,the definition of "refugee" in the relevant treaties cannot cover those in need of protection at this stage and fails to add new content that keeps pace with the times.Secondly,at the level of practical implementation,asylum-seekers as the preliminary status of refugees need to be screened to become refugees,but the current world screening procedures are significantly different and strict.As one of the basic principles of international refugee protection,the principle of non-refoulement also has uncertainty in positioning and application.Finally,in terms of institutional establishment,the United Nations High Commissioner for Refugees(UNHCR)is the most important institution for international refugee protection,but for various reasons,there are all kinds of practical difficulties in the practice of international refugee treatment.Combined with the problems and defects raised in the second chapter,the third chapter puts forward the possible ways of international refugee protection,such as expanding the scope of the definition of refugees,formulating perfect refugee protection procedures,and strengthening the protection capacity of the United Nations High Commissioner for Refugees(UNHCR).The implementation of international refugee protection is expected to contribute to the stability and tranquility of the displaced.In the last,the paper combs the current legal system and current situation of international refugee protection in China,as well as the possible areas to be improved,and puts forward some suggestions accordingly.
