The Dilemma And Solution Path Of Procuratorial Supervision In Cases Of Intersection Of Administrative Law And Criminal Law

As the fields of administrative law and criminal law continue to infiltrate and merge with each other,administrative law and criminal law intersection cases have become more numerous and complex.Because of the different legal relations and law enforcement fields involved,criminal cases and administrative cases are complicated to a certain extent in terms of both substantive handling and procedural connection,making it difficult to handle administrative law and criminal law intersection cases.In addition,the current legislation lacks clear stipulations,and the practical handling methods are not uniform,resulting in a series of problems such as poor connection between administrative law enforcement agencies and public security agencies,and insufficient performance of procuratorial supervision in administrative law and criminal law intersection cases.The procuratorial organs,as the national legal supervision organs,have supervision activities throughout the operation of the law,and can discover the key difficulties and the reasons for the formation of problems in judicial practice in administrative law and criminal law intersection cases in the process of performing legal supervision duties,and explore reasonable and effective investigations from the perspective of procuratorial supervision.To better respond to the judicial needs of the people by establishing a resolution mechanism to resolve the conflicts and disputes among them.Based on the perspective of procuratorial supervision,this paper conducts a practical analysis of administrative law and criminal law intersection cases.The first chapter introduces the advantages and significance of procuratorial organs’ practical analysis of administrative law and criminal law intersection cases by introducing the functions of the procuratorial organs and summarizing the problems existing in the current procuratorial supervision;the second chapter starts from the content of procuratorial supervision,and limits the intersection of procuratorial organs and execution-execution cases to three aspects: case-filing supervision,transfer supervision,and litigation supervision.The characteristics of administrative law and criminal law intersection cases;the third chapter examines the corresponding problems existing in the current procuratorial supervision administrative law and criminal law intersection cases,and analyzes the reasons for the formation of the problems;the fourth chapter discusses the above-mentioned problems On this basis,one by one,the procuratorial organs are put forward to solve the corresponding problems of administrative law and criminal law intersection cases in procuratorial supervision,in order to better play the role of legal supervision and improve the quality and efficiency of supervision based on the positioning of procuratorial organs as legal supervision organs.
