Research On The Legal Regulation Of Owner Autonomy In Urban Community In China

With the construction of more and more residential areas in the city,owner autonomy emerged as an important means of grass-roots autonomy.On the one hand,the happiness of the small family affects everyone’s happiness.On the other hand,in the process of owner autonomy,the problems of the small family can also be solved to solve everyone’s problems,namely social problems.It is self-evident that the owner committee established by law should make good use of its active role.But,as we all know,the owner autonomy system started late in our country,although there are the law of the People’s Republic of China civil code(hereinafter referred to as the "civil code")and the property management ordinance has certain rules to its,has provided a legal basis,for now,however,is still not perfect,are the main problems of the subject status of the owners’ committee is not clear,Its internal supervision is insufficient,thus affecting the improvement of the owner’s autonomy system,which needs to be solved by legal regulation.The author from the current situation of urban district autonomy,in three aspects of the analysis,the first part is the analysis of owner autonomy laws and regulations,related concepts and research status,discusses the scope of owner autonomy and the significance of autonomy.The second part,through the adoption of literature method,survey method and so on to get the owner committee established rate is low,the owner autonomous consciousness and the existing laws and regulations on the provision of owner autonomy is not very clear,in view of the practical problems in our country,by the United States and Japan owner owner autonomy related institutional analysis,find out the problem of the urban district of owner autonomy.In the third part,in view of the problems of owner autonomy in our community,the corresponding improvement measures are put forward.First,the owner’s participation in owner autonomy is guaranteed,and second,the operation system of owner committee is established to perfect the owner’s autonomy system.
