Gender equality in the judge profession does not mean the equal number of male and female judges,but to provide equal opportunities for both sexes to enter the profession.Under the background that the number of female students in law schools far exceeds that of male students,female judges can also become the mainstream force of the judge group.From the perspective of judicial decision-making process,gender factor does not bring negative influence on judicial decision-making in the vast majority of cases.On the contrary,the "caring ethics" of female judges is more humane and more consistent with substantive justice in the judgments of marriage and family cases and juvenile delinquency cases.From the theory of supply and demand,the increase of the proportion of female judges is also in line with the inevitable law of the development of the employment market.Taking the gender composition of judges in four cities of Guangdong Province as an example,most seats and senior positions of the judge profession are still held by men,which has an important connection with the traditional view that law has male attribute and does not conform to the thinking and temperament of women.In addition,the former political and military judge appointment system has obvious male bias,resulting in the imbalance of "more men and less women" in the judge profession.However,judging from the fact that the majority of young judges are women,that there are "more women than men" in the preparatory judge group,and that the graduates of law schools are mainly women every year,the proportion of female judges will further increase,or take the lead in surpassing male judges in developed cities,which may also improve the weak position of female judges in power relations.To achieve gender equality in the judge profession at the present stage,we cannot simply pursue a balanced proportion of male and female,restricting more women from entering the judge industry in the future.Firstly,a real concept of equality should be established: it is necessary to neutralize the judge profession and to break the view of gender essentialism.Secondly,in order to promote the growth of “her power” in the judge profession,an equal career development environment between men and women should be created through the implementation of relevant supporting policies.
