Research On The Legal System Of Public Participation In Budgeting

The development of political democracy has gradually highlighted the dominant position of the public in governance.Based on the political and legal nature of the budget,the public has the right to participate in the budget.However,Chinese budget system still presents the appearance of unilateral operation,the budget still lacks participation,and the public outside the main body of public power has no substantial say in the budget.Budget preparation is the process by which the government formulates the budget revenue and expenditure plan,and is also the core link of the budget process.Public participation in budget preparation is conducive to promoting the democratization of budget decision-making,strengthening budgetary power constraints,and optimizing the allocation of budgetary resources.The practice of public participation in budgeting has been carried out in thousands of cities or regions around the world.Many localities in china have carried out many experiments of public participation in budget preparation based on local conditions while learning from international experience.Constrained by the reality of the current budget system and the inherent limitations of direct democracy,the institutionalization of public participation in budget preparation in china has fallen into the predicament of unclear implementation ideas,weak protection of rights,insufficient motivation for participation,and imperfect supporting systems.Therefore,the institutionalized path of public participation in budget preparation needs to be optimized urgently.In addition to the introduction,this thesis consists of four parts.The first part first explains the theoretical basis of public participation in budgeting in terms of politics,economy and law,then interprets the value of public participation in budgeting,and finally clarifies the participants,objects,levels and boundaries of public participation in budgeting,so that Lay a theoretical foundation for subsequent research.The second part first compares and analyzes the practical cases in Brazil,Indonesia,Japan,Guangdong,Hainan,Shanghai and other places,and then finds out the problems faced by the public participation in budget preparation in my country in terms of implementation ideas,legal support,development momentum,and supporting systems.institutional dilemma in order to grasp the current state of public participation in budgeting.The third part first determines the overall goal and realization path of public participation in budget preparation,and then proposes the four principles of equal participation,negotiation and interaction,convenient participation,and openness and transparency in public participation in budget preparation,so as to carry out the top-level design of the public participation system in budget preparation.The fourth part specifically optimizes the public participation system in budget compilation by implementing the right to participate in the public budget compilation,strengthening the motivation support for participation,and improving the supporting system for participation.
