Research On The Path Of Standardization Of Immigration Police Law Enforcemen

The Fourth Plenary Session of the Eighteenth Central Committee of the Party pointed out that the Chinese dream of building a well-off society in an all-round way,realizing the great rejuvenation of the Chinese nation,comprehensively deepening reforms,improving and developing the socialist system with Chinese characteristics,and improving the party’s ability and level of governance,must comprehensively promote the rule of law.Facing the requirements of the rule of law,the exercise of police administrative power by public security agencies should be restricted by judicial power,and should also be subject to the checks and balances of civil rights such as the right to silence,and put it under the supervision of the society.Under the background of the rule of law,law enforcement standardization is conducive to promoting the transformation of the work model of public security organs.In2018,China established the National Immigration Administration.As an important administrative law enforcement department,the National Immigration Administration shoulders the burden of guarding the country’s door,ensuring the safety of people’s lives and property,and maintaining social order.It also plays an important role in implementing the strategy of governing the country by law and building a government ruled by law.However,due to the initial establishment of the immigration management agency,it is still in the transition stage,and the relevant legal system has not yet been formed,there are legal conflicts and overlapping powers in the original public security law enforcement,exit and entry management,foreign immigration management and other aspects of China,resulting in the irregular behavior of the immigration management police in the law enforcement process.The construction of the current rule of law society and the standardization of law enforcement construction caused certain obstacles.This paper takes the construction of National Immigration Administration police law enforcement standardization as the research direction and defines the relevant concepts of immigration administration law enforcement standardization.Based on literature research,interview and case analysis,this paper takes Guangzhou immigration inspection station as an example to describe the basic constitution of the standardization construction of law enforcement briefly.Combined with the function characteristics of NIA police,this paper lists the outstanding problems existing in the police enforcement of Guangzhou immigration inspection station,and analyzes the causes of the problems.Finally,measures to strengthen the standardization construction of law enforcement are put forward from five aspects: strengthening the ability of law enforcement subjects to perform their duties according to law,perfecting the law enforcement system,strengthening the information construction of law enforcement,improving the evaluation method of law enforcement quality,and establishing a comprehensive law enforcement supervision and management system.To provide reference for exploring the construction of immigration legal system,immigration law legislation,and regulating the enforcement behavior of immigration management police in China.In order to realize the construction of the rule of law society and rule of law.
