Research On The Value Structure Of China’s National Defense Law

On December 26,2020,the twenty-four sessions of the thirteen the Standing Committee of the National People’s Congress deliberated and adopted the newly revised National Defense Law of the People’s Republic of China.Focusing on the overall national security and development strategy for the new era,the national defense law adapts to the new situation and new tasks after the reform,and enriches and standardizes the basic principles and basic systems in the field of national defense and military construction,it is of great significance to the construction and development of national defense.For a long time,the research on the value structure of the national defense law is still in its initial stage.As a Basic Law in the field of national defense and Military Affairs,the national defense law contains rich elements of value,it mainly includes national defense rule of law,National Defense Order,National Defense Justice,National Defense Security,national defense modernization and party leadership.The value elements of the national defense law are interrelated and can be divided into fundamental value,basic value and important value according to the different status and role of the value elements of the national defense law,and form three levels of value structure.The law has the stability characteristic,but the society is in the constant change,therefore "national defense law" value structure needs to adjust in the dynamic,in order to meet the national and the social development need.The dynamic value structure of "National Defense Law" is not achieved in one move and is static,but the basis,condition and law of its existence value structure.The value construction of the national defense law overemphasizes the legal attribute of value and undervalue the construction of its military attribute,it is necessary to stress the military attribute of the national defense law as the logical starting point of the value optimization of the national defense law.According to the value structure and value optimization path of the National Defense Law,this paper points out the shortcomings of the national defense law,and forward some suggestions for its revision,so as to promote the realization of the value of the national defense law of our country,building socialism with Chinese characteristics and ruling by law in national defense.
