Research On The Legislation Of The North China People’s Government In 1948-1949

The North China People’s Government was established in the late Liberation War and the early days of the People’s Republic of China,and lasted from September 1948 to October 1949.As a new type of people’s democratic regime,it realized the transition from the guerrilla form to the formal form of people’s power established by the Communist Party of China,and it has a special importance.During the 13 months of its existence,the North China People’s Government promulgated more than 200 laws and regulations,covering the areas of social life,public security and justice,and economic construction.These laws and regulations provided the legal basis for the work of the North China People’s Government and laid the foundation for the legislative work after the founding of New China,which is called "the place where the rule of law of the Republic began".While the nationwide war was still going on,the North China People’s Government was tasked with concentrating the forces of the liberated areas in North China to support the war on the front line,while facing the challenges of consolidating the fruits of the victory of the New Democratic Revolution,stabilizing the order of the liberated areas,and restoring economic and cultural development.In this special environment,the North China People’s Government enacted a large number of laws and regulations to ensure the orderly operation of the government on the basis of the new system.Based on the historical facts of the legislation of the North China People’s Government this paper examines the legislative practice of the People’s Government of North China as a whole,comprehensively examines the process of its establishment,its significance,and the historical environment in which it was established,and analyzes the necessity and urgency of its legislation.By systematically examining and objectively evaluating the achievements and significance of the administrative,economic,criminal and civil legislation of the North China People’s Government,the characteristics and significance of the legislation of the North China People’s Government are further analyzed.In general,the legislation of the North China People’s Government was distinctly transitional and comprehensive in scope.However,since the nationwide liberation war had not yet ended,the North China People’s Government had to quickly enact various laws and regulations to build the institutional foundation of the North China Liberation Area,resulting in a lack of overall legislative content and specialization of legislative subjects.However,it is undeniable that a large number of laws and regulations promulgated by the North China People’s Government during that special historical period did provide legal compliance for the stability of social order and had an important impact on the construction of the legal system in the early years of the founding of New China,which still has important practical value and research significance today.
