As one of the three major ecosystems in the world,wetland provides a considerable number of ecosystem services for human beings.Protecting wetland ecological environment is of great significance to human well-being and sustainable development.Water is the basis of ecology.Any healthy and stable ecosystem needs appropriate water resources.As a party to the Ramsar Convention,China has national obligations to ensure the environmental water-use in wetlands in accordance with the contents of the Convention.Under the background of the construction of global ecological civilization,it is of great significance to study the national obligations of wetland water-use allocation under the Ramsar Convention.This thesis aims to study the national obligations of wetland water-use allocation under the Ramsar Convention.With logical methods,comparative methods and normative analysis methods,firstly,based on the legal theory of eco-environmental water-use allocation,this thesis systematically combs the national obligations of wetland water-use allocation under the Ramsar Convention for the first time;Secondly,it makes a comparative study on the wetland water-use allocation policies and legal practices of the United States,Britain and Canada;Finally,it discusses the compatible approach between current policies and laws of China and the contents of national obligations under the Ramsar Convention,and puts forward policy and legal suggestions on how to better fulfill the national obligations under the Convention.This thesis is divided into five parts.The first part discusses the legal theory of water allocation of the environmental water-use of wetlands.Supported by the national obligation of wetland water-use allocation under the Ramsar Convention,the second part discusses the national obligation of wetland water-use allocation from three aspects: the determination and connotation of national obligation,the traceability of concept and the division of levels.Taking the contents under the Ramsar Convention as the main line,the third part combs the contents of the national obligations of wetland water-use allocation under the Ramsar Convention from three aspects: the overview of the Ramsar Convention,the obligations of parties under the Convention and the strategic plan of the Convention.The fourth part combs the policy and legal practice of wetland water-use allocation in the United States,Britain and Canada from three aspects: the institutional structure of water resources allocation,the legal status of wetland water-use and the performance practice of wetland water-use allocation.The fifth part discusses the situation of fulfilling the national obligation of wetland wateruse allocation in China,the compatible approach between performance practice and performance obligation,and puts forward the improvement path for the existing problems.As a party to the Ramsar Convention,China should actively fulfill the national obligations under the Convention;This includes the compliance requirements of the documents under the Ramsar Convention on the allocation of wetland water-use by parties,and the compatibility with the contents of the convention from the three levels of legislation,law enforcement and social supervision,so as to realize the full implementation of the Ramsar Convention in China.There are two main innovations in this thesis.Firstly,it systematically combs the content of the national obligation of wetland water-use allocation under the Ramsar Convention for the first time,which is reflected in the research and analysis using new research materials as arguments,enriching and developing the existing theoretical viewpoints,and making a breakthrough in the research of documents under the Ramsar Convention.Secondly,comparative and interdisciplinary research on the content of state obligations has been carried out from the perspective of international law and domestic law,and some new progress has been made.
