Research On The Legal Regulation Of Network Virtual Currency In China

Since the 1990 s,With the development of Internet economy and the emergence of virtual currency,a new upsurge has been set off in our economic life.Virtual currency has been widely used in major forums,online games,online shopping and other network applications.Although network virtual currency has brought huge benefits to our economic life,everything has two sides,and the risks it brings to us can not be ignored.At present,the legal norms of online virtual currency in my country present a decentralized structure.Although there are normative documents,they only exist in the form of notification documents,and there is no systematic legal system to guarantee the effective operation of online virtual currency.Due to the imperfection of legislation,the operation of virtual currency in the network is not supervised by special organs,and it also gives criminals an opportunity to take advantage of it.As a result,the legitimate rights and interests of consumers can not be protected,and the legal system can not be better implemented.Therefore,my country must strengthen the guidance and supervision of network virtual currency in legal regulation.Starting from the historical background of network virtual currency,this paper clarified the concept of network virtual currency,combined with the legal property of network virtual currency,learned from the successful experience of foreign network virtual currency,and constructed a legal regulation system of network virtual currency.Starting from the prominent characteristics of legal attribute and high risk of network virtual currency,this paper analyzes the legal regulation of network virtual currency from the four aspects of issuance,circulation,responsibility distribution and supervision,and puts forward its own suggestions for improvement from these four aspects.In the field of issuing,because the mechanism of issuing access is not perfect,the author puts forward to perfect the main body of issuing access and formulate strict access standards.In the field of circulation,due to the lack of strict transaction management system,it is proposed to set up the real-name system of trading platform,and further improve the transaction management system for the effective circulation of network virtual currency.In the field of responsibility division,due to the lack of clear responsibility division system,we should improve the responsibility division system from the perspective of the responsibility subject.In the field of supervision,due to the lack of systematic supervision chain,the supervision subject,supervision field and enforcement force are analyzed to construct the supervision chain of network virtual currency.It is hoped that by improving the legal regulation of online virtual currency in my country,the development of online virtual currency can be promoted so as to promote the prosperity of my country’s economy.
