Under The Social Governance Angle Of View Our Country "the Previous Conviction Eliminates" The System Construction Research

The system of criminal record reporting increases the cost of crime and helps prevent crime by distinguishing ex-offenders in the form of labels.However,with the development of society,the social problems caused by the criminal record reporting system have become more and more prominent,mainly the intensification of conflicts between ex-offenders and law-abiding citizens,as well as the unfair and unequal treatment of ex-offenders and their close relatives in aspects of life,employment and study,solving these problems concerns social harmony and stability.The concept of "Social Governance" proposed by the CPC calls for the modernization of the country’s governance system and capacity,the innovation of the social governance system,the continuous improvement of the modernization level of social governance and the handling of social contradictions,maintain social harmony and stability.The system of "Abolition of criminal record" is a reform of the reporting system of criminal record and an innovation of China’s legal system and social governance system,and the domestic academic research and the practice exploration have obtained the progress,should change the idea,constructs our country characteristic socialism "Abolition of criminal record" the system,realizes from "The management" to "The governance".This paper,from the perspective of social governance,comments on the advantages and disadvantages of the current criminal record system in China,and demonstrates that the establishment of the system of "Abolition of criminal record" is the need of the legalization of social governance,mainly reflected in the construction of modern rule of law system,cultivate the spirit of modern rule of law,enhance social security prevention and control requirements.In addition,the establishment of the system of "Abolition of criminal record" is also the need of socialist human rights governance,which helps to achieve social harmony.At the same time,this paper analyzes the establishment of the system of "Abolition of criminal record" in accordance with the value orientation of social governance of law and morality,the requirements of fair and just social governance,and the spirit of the rule of law in social governance.Of course,the construction of the system of "Abolition of criminal record" is also faced with practical problems,including the negative effect of retribution culture,possible initiation of new social problems,and the design of the system of "Abolition of Criminal Record" is also complicated.According to the above argumentation,thesis paper puts forward some thoughts on the construction of the system of "Elimination of criminal record",including legislative design,judicial protection and policy support.
