Abstract/Summary:
Chinese minimum wage guarantee system plays a significant role in ensuring the salary rights and interests of labors and sustaining the stability of the workers market.With the sudden eruption of COVID-19 in 2020,strict epidemic prevention and control measures have greatly affected the production of enterprises,and a lot of conflicts have occurred between labor and management owing to salary payment issues,and the rights and interests of workers at the minimum salary have not been well protected.This article takes this as a starting point,combined with the epidemic to study the minimum wage guarantee system,first of all,starting from the provisions of China’s current minimum wage system,through system combing and empirical research,we found the problems existing in the current minimum wage security system in China,and on the basis of drawing on advanced experience outside the region,we put forward suggestions for improving Chinese minimum wage guarantee system under the epidemic,hoping to better protect the rights and interests of workers.The article is divided into four sections,the main points of which are as follows:In the first part,the basic theory and current situation of the current minimum wage guarantee system in China are sorted out,and an overview of the basic concept,characteristics,theoretical basis,development history and significance of the minimum wage guarantee system is given.The second part collects and sorts out typical cases involving the minimum wage under the epidemic for empirical analysis,and summarizes the problems existing in China’s minimum wage guarantee system under the background of the new crown epidemic.Through the sorting out of the system and case studies,three aspects of China’s minimum wage guarantee system are proposed: the system itself is not scientific in legislation and design;the distribution of minimum wage risks under the epidemic is unreasonable;and the minimum wage supervision and management mechanism is absent.In the third part,primarily analyzes the minimum salary system in the UK,the USA,and Japan,and analyze the mechanism of setting,adjusting,and regulating the minimum wage in the light of their legal provisions,so as to learn from them useful experiences that can solve the problems of the minimum wage system in China under the epidemic.The fourth part puts forward the idea of improving China’s minimum wage guarantee system.To improve China’s minimum wage guarantee system under the new crown epidemic,we should follow the principle of preferential protection and balance of interests.Specific suggestions for improvement: First,improve the design of the minimum wage system and relevant laws and regulations,it is necessary to raise the legislative level of the minimum wage,set up a special committee to be responsible for the decision-making of the minimum wage,and reasonably raise the minimum wage standard.Second,for the distribution of minimum wage risks under the epidemic,it is necessary to consider the enterprise’s wage risk tolerance,distinguish between different situations,clarify the responsibilities of the government and enterprises,reasonably determine the minimum wage risk burden rules,and establish a wage compensation mechanism for workers under the epidemic prevention and control policy to share the pressure of the employer’s wage burden.Third,with regard to the lack of a minimum wage supervision and management mechanism,by strengthening the social responsibility of employers,giving play to the role of government supervision and trade union supervision,and enhancing the punishment for breaking the minimum salary system,we will always improve the supervision system of minimum wage system,protect the basic rights and interests of workers,and maintain social stability.
