Governance Of Chaos In The "Fan Quan"

The evolution of science and technology has broken the time and space constraints and the popular star chasing model has undergone subversive changes.From the passive-active process,the "Fanquan" culture has developed rapidly,and the initiative and participation of fans have been continuously enhanced.Fans have a fixed organizational structure and a clear division of labor.Coupled with the blessing of the Internet,the fostered idols model in 2018 has become a new model in the entertainment market.With the emergence of the new model,the "Fanquan" has developed rapidly and disorderly under the control of capital.There have been phenomena such as trolling,attacking rumors,human flesh searches infringing on privacy rights,creating false traffic,voting on lists,and irrational consumption.The frequent occurrence of chaos has impacted the orderly entertainment market economy.As fans of consumers,their interests are harmed,the interests of other legitimate operators are damaged,the normal competition order are disrupted,and public interests are harmed.In June 2021,the Central Cyberspace Administration of China will launch a special campaign of "Clean-up and Rectification of Chaos in the ’Fanquan’".Due to the complex legal relationship between the behavior of fans of "Fanquan" in my country,the current regulation is mainly based on short-term policies,the relief methods are relatively simple,and the behavior the criteria for identifying subjects are ambiguous and the attribution of responsibilities is difficult,resulting in poor performance in chaos control.This article takes this as the starting point.By sorting out the chaos of the "Fanquan",clarifying the operation logic of the fostered idols model,trying to deconstruct the fostered idols subject,and identifying the responsibility.Through case analysis,the reasons for the ineffective governance of the "Fanquan" chaos were analyzed,and the main responsibilities of the "Fanquan" were consolidated to make the "Fanquan" governance legalized,and to improve the effectiveness of the "Fanquan" chaos governance.The lack of existing legal regulations and the single method of dispute resolution are caused by the deviation of the subject identification in the legal relationship.In terms of legal relations,it is necessary to clarify the subject of responsibility and to consolidate the responsibility of the subject.By clarifying the identification standards and responsibilities of star brokerages,idols,professional fan organizations,and professional fan operators,break through tort liability and assume legal responsibility for unfair competition.Platforms need to strengthen technology and content supervision,and assume anti-monopoly responsibilities.At the same time,each subject needs to undertake the construction of a firewall with legal responsibility,the platform needs to bear the legal responsibility for the protection of minors rights and interests,the platform implements the responsibility of establishing a healthy network ecology,and implement the guiding obligations of star brokerages,idols,and professional fan operators through written regulations.Take multiple measures to restore the normal ecological environment of the "Fanquan" under the fostered idols model,accelerate the healthy and orderly development of the cultural entertainment industry,safeguard the lawful rights and interests of fans,especially minor fans,maintain oderly competition in the entertainment market,and carry forward core values.Enhance cultural self-confidence and create a clear network cultural environment.
