Research On The Application Of The Crime Of The Impostor

The introduction of impostor crime provides a criminal law basis for punishing and cracking down on impostor crime.For the impostor behavior of various forms,how to carry out the specific application of criminal law,to achieve accurate strike and effective punishment of impostor criminal behavior,is a realistic problem that must be faced at present.This paper takes "the impostor crime applicable problem research" as the topic,is also an attempt to this.The thesis is mainly discussed from six aspects: Introduction,mainly based on imposter event leads to this thesis;The second chapter focuses on the "impostor" behavior is systematically combed and defined;The third part of the paper,detailed analysis of the impostor crime preparation crime,attempted crime and discontinuation of crime,especially the criminal law legislation on the impostor crime of organizational behavior,in terms of the number of crime form,it is believed that the impostor crime does not belong to the continuing crime;The fourth part of the thesis mainly defines the crime of impostor and the crime of using false identity certificate,stealing identity certificate,the crime of substituting for examination and the crime of organizing cheating in examination.The fifth part of the paper analyzes the limitation of prosecution for impostor crime,points out the specific problems existing in the current application,and proposes to set up a separate limitation of prosecution.Finally,in the concluding part,the paper proposes to include impostor institutions,three branches and one support,state-owned enterprise recruitment and other fields into the scope of criminal law regulation.
