Since the Fukushima nuclear power plant accident in Japan,the treatment of nuclear wastewater by the Japanese government and Tokyo Electric Power Company has been the focus of the international community.Recently,the Japanese government has adopted a plan to discharge 1.23 million tons of nuclear sewage stored at the Fukushima nuclear power plant into the Pacific Ocean,which is undoubtedly an illegal act in international law.Many countries are dissatisfied with this.As the leader of this nuclear wastewater discharge,the Japanese government should bear its due international responsibility.From the perspective of state responsibility theory,this paper is divided into six parts to explore how the perpetrator should bear state responsibility in nuclear pollution accidents such as nuclear wastewater discharge.The first part introduces the research background,research methods and research purpose of this paper.The second part introduces the general situation of Fukushima nuclear leakage accident and the plan of Fukushima nuclear wastewater discharge.The third part introduces the theoretical system of state responsibility,and the fourth part introduces the basic responsibility of the Japanese government for violating international law and the international conventions to which it is a party.The fifth part discusses why Japan,as the main body of international exchanges,should bear national responsibility and the form of national responsibility.The sixth part puts forward some suggestions on how the Japanese government should bear the national responsibility and treat the nuclear wastewater problem together with other countries in the world.The large impact and wide range of nuclear wastewater discharge are related to the fate and future of global mankind.The Japanese government should clarify its responsibilities,safeguard the interests of coastal countries,and further accelerate the harmless treatment of nuclear wastewater. |
