Study On The Recognition And Enforcement Of Foreign Civil And Commercial Judgments In My Country

In the context of economic globalization,trade between countries has become more and more frequent,and it has also spawned foreign-related economic disputes with various causes.The resolution of disputes often depends on specific judicial organs.difficult practical problems.In this paper,transnational enforcement of international civil and commercial judgments are summarized,and the voices of scholars in the field of international law discussing the recognition and enforcement of foreign civil and commercial judgments are listened to and summarized,summing up and comparing the domestic legislation and the system design of international treaties carried out by other foreign countries in the fields of foreign-related civil and commercial affairs and Transnational Implementation,the author makes some useful and practical suggestions on the legislation and judicature,foreign court judgments in China,hoping that some day in the future,the research results of this paper can play an important role in revising the civil procedure law concerning Foreign Affairs and drafting the relevant judicial interpretation.The full text is divided into three parts: Introduction,text and conclusion.The body is divided into three parts: the first part describes the author’s theoretical and practical understanding of international civil and commercial judgments,it theoretical category,and the applicable principles and statistics of practical category In the second part,from the perspective of the deficiency of the International Execution System of civil and commercial judgments and the practical difficulties of applying the principle of reciprocity,the author analyzes the current practical obstacles and the defects in the international execution of civil and commercial judgments In the third part,on the basis of the above-mentioned research and elaboration,referring to other national legislation and relevant international regulations,how to perfect transnational execution of international judgments in civil and commercial matters,and accordingly put forward to improve the transnational execution of international civil and commercial judgments and suggestions.
