Study On The Environmental Exemption System Of Our Country’s Anti-monopoly Law

With the unprecedented development of globalization,countries around the world are paying more and more attention to ecological and environmental protection issues while paying attention to economic development.On the one hand,our country has stepped up the revision and improvement of ecological environmental protection legislation,and on the other hand,it has set up supporting environmental protection clauses in relevant laws.Among them,the environmental exemption system stipulated in Article 15 of my country’s Anti-Monopoly Law is the environmental protection clause Corresponding manifestation in the field of anti-monopoly law.However,because the provisions of the system are too principled and general,there are problems such as unclear identification standards,unclear application conditions,and vague application procedures,which makes the system not well implemented in practice,and some monopoly enterprises use the environmental exemption rules instead.Justifiably implement monopoly behavior.Therefore,our country’s anti-monopoly environmental exemption system is a legal subject that urgently needs to be studied and improved.In the anti-monopoly environmental exemption entity system,environmental benefit defense rules should be added,the principle of environmental exemption proportion should be established,and relevant concepts such as environmental agreements,consumers and shared environmental benefits,and the inability to severely restrict competition should be clearly defined,so as to accurately apply the anti-monopoly environment.In terms of the antitrust environmental exemption procedure system,the environmental exemption review procedure should be strictly enforced,the environmental exemption relief procedure should be improved,and the environmental exemption enforcement supervision procedure should be strengthened,so that the implementation of the antitrust environmental exemption system can achieve due effect.
