In recent years,under the close cooperation of government departments and the active response of the public,my country’s environmental protection cause has made great progress,the forest coverage rate has increased year by year,and the integrity of the ecosystem has been effectively protected,creating favorable conditions for the survival of wild animals.In addition,after years of hard work,my country has formed a sound legal Wildlife Conservation System,and severely cracked down on the trafficking and poaching of wild animals.Due to the above two reasons,the number of wild animal populations in my country has been rapidly recovered and expanded,and there is a trend of "beasts advancing and human beings retreating",especially in remote mountainous areas and near nature reserves,conflicts between humans and animals occur from time to time,which seriously affects the aboriginal people.The production and operation and traditional livelihood of the people have also damaged the enthusiasm of the people to protect wild animals.In order to balance public and private interests,protect the basic human rights of victims,and ensure the effective implementation of wildlife protection policies,as early as the first Wildlife Protection Law of China,my country clearly stipulated that citizens who suffered personal injury or property damage due to accidents caused by protected wildlife The government will provide them with corresponding financial compensation.After 20 to30 years of development,although this system is relatively mature,it still has many flaws that deserve to be improved.This article will elaborate on the background of the system,the theoretical origin of the system,how to identify the nature of the system,the defects of the system and how to improve it.In order to achieve this purpose,the author will discuss the system from six aspects:as the beginning of the article,the introduction mainly introduces what social background the research object of this paper is based on,what research results are currently available at home and abroad,what aspects will be discussed in this paper,and what research methods may be used;the second part is the compensation system for wild animals and wild animals.The concept of the system is introduced,and then the practical significance of establishing the system is clarified;the third part is the elaboration of the theoretical origin of the system;the fourth part puts forward the author’s thinking on the nature of the system on the basis of introducing the relevant theories about the nature of the system;The fifth part is divided into two subsections.The first section gives a macro overview of the current legislative situation,and the second section points out the shortcomings of the existing system in terms of legislative system,responsible subjects,compensation scope,compensation procedures,and compensation standards.In view of the system defects described in the fifth part,specific suggestions for improvement(such as expanding the scope of compensation for wildlife damage,etc.)are put forward,so as to achieve the purpose of this research.
