Research On Trust Property Registration System In China

The trust property registration system is a special registration set up to ensure the independence of trust property.Completed trust property registration system has not yet been established in China,so various alternative schemes are often adopted in practice.At present,China’s trust property registration system has many problems.First,The unclear ownership of trust property results in the uncertainty of the design of the trust property registration system.Meanwhile,the lack of supporting rules for trust property registration results in the impossibility of carrying out trust property registration in practice,and fundamental theoretical issues such as disputes over the validity of trust property registration still need clarification.It shall be clarified that the trust property belongs to the trustee to determine the name under which the trust property shall be registered.The theoretical basis of trust property registration involves many aspects.Firstly,the concept of property trust registration is different from the trust registration.First of all,the concept of trust registration shall be different from that of trust property registration.The source of trust property registration is property right change registration,which is necessary to protect the independence of trust property and transaction safety.Secondly,there is an urgent need to change the principle of trust property registration from registration effectiveness to registration antagonism,and clarify the responsibilities of trust property registration.In the specific design of the system,the object of trust property registration in China shall be trust property.The scope of the registration shall cover the effective and opposing property in the real rights change registrations,and the trust property registration authority shall review the form of registration.Meanwhile,registration correction and other remedial measures shall be specified.
