Obstacles And Countermeasures In The Implementation Of Supervisory Suggestions

Supervisory suggestions is not only an important means for the supervision organs to carry out anti-corruption work,but also a new supervision method produced in the reform of the national supervision system.In the process of implementation,the supervisory suggestions are faced with problems such as lack of uniformity in name,lack of standardization in approval procedures,lack of pertinence in the contents of the suggestions,lack of attention to afterwards relief,inconsistency in the main body of preparation,issuance and implementation,lack of initiative in supervision and Implementation,and lack of effectiveness in the implementation results,which not only affect the seriousness of the supervision recommendations,but also affect their anti-corruption effectiveness.In view of the above problems,the full text takes the basic theory-implementation status-obstacles-countermeasures as the idea,and is divided into five chapters to discuss the obstacles and Countermeasures in the implementation of supervisory suggestions.First,after sorting out the concept and characteristics of monitoring recommendations,it is necessary to clarify the differences and links between supervisory suggestions and other suggestions on this basis,so as to provide theoretical groundwork for follow-up research.Second,in view of the non-public documents of the trial norms of supervisory suggestions and supervision proposals formulated by local governments,the reports with the title of "supervisory suggestions" on the official websites of national and provincial supervisory committees are used as materials to sort out the supply of local norms and study the implementation status.By sorting out and analyzing these reports,this paper studies the implementation status of supervisory suggestions under the current system supply.It is concluded that at present,the supervisory suggestions have indeed achieved some results,that is,the supervision organs strictly abide by the regulations at the level of preparation and development,and extend the personal supervision to the matter supervision,which has laid the foundation for the construction of the anti-corruption mechanism.At the level of supervision and implementation,the institutional advantages of the supervisory suggestions have been continuously transformed into governance effectiveness,but there are also some obstacles that affect the efficient play of the anti-corruption effectiveness of the supervisory suggestions.To sum up,since the implementation process of supervisory suggestions can be divided into two links: preparation and issuance and supervision and implementation,countermeasures are proposed from these two links to ensure that the supervisory suggestions can give better play to the effectiveness of anti-corruption.Four points should be perfected in the process of preparation and issuance: first,unify the name of the supervision proposal and maintain its authority as a legal document;Second,improve the examination and approval procedures.That is to distinguish the examination and approval subjects and methods of the independent supervisory organs and the dispatched(outgoing)supervisory organizations,and clarify the examination and approval contents;Third,improve the pertinence of the suggestions.That is,prior communication with the proposed unit and internal linkage of the supervisory authority should be carried out before the preparation and issuance.In addition,in case of non legal problems and professional problems,the professional strength of a third party can also be used;Fourth,construct the objection procedure.First of all,it is necessary to clarify the justifiable reasons.Secondly,it is necessary to give the proposed unit the opportunity to raise an objection in writing within one month from the date of receiving the proposal.Finally,it is necessary to establish a dispute resolution mechanism,in which the preparation and issuance body,the people’s Congress at the same level and its Standing Committee serve as the subjects of the first and second rulings respectively.It is clear that the implementation of the proposal will not be stopped during the objection period,and different treatments will be made according to different rulings.Three points should be improved in the process of supervision and Implementation: first,standardize the main body of supervision and implementation of suggestions.That is,the development subject must participate in the implementation of supervision,and other supervision subjects must have the two conditions of understanding the investigation,the content of suggestions and having the right to supervise the proposed units to participate in the implementation of supervision;Second,establish accountability procedures.Make clear the lack of initiative in the implementation of supervision,and then the supervisory committee at the next higher level,the special supervisory organization within the supervisory committee at the same level,the people’s Congress at the same level and the people’s Congress at the same level shall determine that the subject of supervision and implementation has such behavior,and then the responsibility can be traced by referring to Article 279 of the regulations for the implementation of the supervision law of the People’s Republic of China;Third,set up a return visit evaluation mechanism.A return visit group composed of key personnel supervising the investigation,authorities who have conducted in-depth research on the case issues,deputies to the National People’s Congress and leaders of the proposed unit adheres to the concept of "one proposal and one return visit".After the field investigation,the implementation is evaluated by holding demonstration meetings or symposiums,and different methods are adopted according to different evaluation results.
