| In China,the food safety reporting reward system has been in operation for more than ten years and has achieved some success.Recently,the State Council promulgated the Interim Measures for Reporting Rewards for Major Violations in the Field of Market Supervision,attempting to extend the practical experience of the reporting reward system in the field of food safety to the entire field of market supervision.However,the food safety reporting reward system is still not perfect,and operational issues limit the system’s effectiveness.This paper examines the current situation,identifies problems,analyzes the problems,and makes recommendations for optimizing this system,attempting to improve the design of the food safety reporting incentive system and to extend a more scientific and realistic reporting incentive system to the entire market supervision field.The first part clarifies the concepts of reporting,reporting reward,food safety reporting reward,and the functions of the food safety reporting reward system in order to achieve a comprehensive understanding of the basic concept of the food safety reporting reward system.The second part examines the operation of the food safety reporting reward system in practice,dividing the system into three stages: normative guidance,procedural operation,and rights relief,and tries to summarize the advanced practices in each stage through empirical analysis.In the third part,on the basis of understanding the current situation of the system’s operation,three problems are found in the operation of the food safety reporting reward system: the substantive law provisions are not detailed enough,the design of procedural rules is defective,and the remedies are few and weak.In the fourth part,to solve those problems,there is a system optimization plan proposed.First,delineating the participation conditions of reporting reward system,specifying the rights and duties of regulatory agency,and clarifying the criteria for reward recognition,the substantive law of food safety reporting reward is refined;Secondly,in terms of optimization of procedural law,it takes the practical experience into consideration,simplifies the procedures at each stage,establishes an information disclosure system,and improves internal and public supervision;Finally,multiple remedies are offered,by the establishment of information security system and information leaking accountability system,and the clear legislation of administrative reconsideration and administrative litigation as remedies,reporters can be protected. |
